هذه المادة تتناول البحث في مدى اعتراف الشريعة الإسلامية بحقوق الإنسان, حيث جاءت النصوص القرآنية والأحاديث النبوية الشريفة توضح أهميه المحافظة على الحياة الإنسانية بوجه عام, و تتلخص دراسة هذه المادة في الوصول من خلال المناقشات البحثية الإستكشافيه, ودراسة العديد من الحالات الخاصة بهذه الدراسة إلى ما يلي :-
- استنباط حقوق كلا من المسلمين وغيرهم في المجتمع المسلم, والزوجين والطفل وأيضا ذوي الاحتياجات الخاصة, وذلك من خلال النصوص الواردة في القرآن الكريم والسنة النبوية الشريعة.
- دراسة المميزات والسمات التي تتميز بها حقوق الإنسان في الإسلام, من حيث كونها حقوق ربانيه, يكون القصد والهدف منها هو رضا الله تعالى, وحقوق إنسانيه, بالإضافة إلى كونها حقوقا شامله لجميع مجالات الحياة الإنسانية, وثابتة دائمة لا تقبل التغيير, فضلا عن كونها حقوقا مكفولة في إطار الشريعة الإسلامية, وحقوقا أخلاقيه فطريه لتحقيق الكرامة الإنسانية.
- تناول العديد من الحقوق والحريات الخاصة بالمسلمين وغيرهم, والتي يعد منها الحق في الحياة, والحرية والمساواة, والعدالة, وحق الحرية الدينية, وحق العمل, والحق في المشاركة في الحياة العامة, والحق في الكرامة, والأمن, والخصوصية, وأيضا حرية الاجتماع, وحقوق الأسرة وغير ذلك من الحقوق والحريات الأساسية في ضوء أحكام الشريعة الإسلامية, والأدلة الواردة في القرآن الكريم والسنة النبوية.
